These Terms of Service ("Terms") govern your access to and use of Tunnls (the "Service"), operated by Emissare, Inc. ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Tunnls is a web-based tool that transmits real-time information between an account holder ("Operator") and a third party ("Visitor") within time-limited sessions. Field values are end-to-end encrypted between Operator and Visitor browsers; plaintext never reaches our servers. Session metadata (room code, duration, operator identifier, timestamps) is stored by us to operate and bill the Service.
You must be at least 18 years old to register as an Operator. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized access.
You agree not to use the Service to:
Operators are solely responsible for their use of the Service with Visitors, including obtaining any legally required consent to collect, process, and retain Visitor information in their own systems. We relay end-to-end encrypted payloads on behalf of the Operator (and act as a processor under applicable data protection laws); we do not independently contact Visitors.
Tunnls offers a free tier with usage limits and paid subscription tiers. Paid subscriptions are billed in advance on a recurring basis via our payment processor, Stripe. You authorize us and Stripe to charge the payment method you provide for all applicable fees.
Subscription fees are non-refundable except where required by law. You may cancel a subscription at any time from your account settings; cancellation takes effect at the end of the current billing period.
You may close your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we are required to do so by law. On termination we will delete account data in accordance with our Privacy Policy.
The Service, including its underlying software, design, and branding, is owned by Emissare, Inc. and protected by applicable intellectual property laws. You retain all rights to content you or your Visitors submit through the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, AND WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Emissare, Inc. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS IF YOU HAVE NOT MADE ANY PAYMENTS.
You agree to indemnify and hold us harmless from any claim, damage, or expense arising from your misuse of the Service, your violation of these Terms, or your violation of any third party's rights.
We may update these Terms from time to time. Material changes will be announced via email or in-app notice at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles.
